Enticing surrounding communities and island travellers
As our community features many historic buildings with aging infrastructure—such as crumbling facades and old waterlines—the Chemainus Business Improvement Association (CBIA) Board in 2024 implemented a policy to ensure safety and mitigate risk. To that end, any business or property owner wishing to install a hanging basket on a building facade must first sign a liability waiver.

The above, hereafter referred to as the "Business". It is governed by the laws of British Columbia.
CBIA will supply hanging baskets ("Baskets") on the Business's premises, with and install, limited maintenance, and removal provided by Cyran Gardens.
Scope and Liability: CBIA is not liable for any damages, injuries, losses, or liabilities related to the Baskets. The Business accepts full responsibility for any associated issues and agrees to indemnify and hold CBIA harmless against any related claims. The Business also releases Cyran Gardens from all liability.
Removal of Baskets: Baskets will be removed by October 30th, 2025, or earlier if in poor condition, without notice. The Business must manage water lines before, during, and after removal without being prompted. CBIA and Cyran Gardens are not liable for any damage during or after removal. The Business may choose to remove the Baskets themselves.
This Agreement constitutes the entire understanding between CBIA and the Business and supersedes all prior agreements.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date of May 20, 2025.
