This Agreement is between the Chemainus Business Improvement Association (CBIA) and the business owner, property owner, or authorized representative operating at the address listed below (the “Business”). This Agreement is governed by the laws of British Columbia.
CBIA will supply hanging baskets ("Baskets") on the Business's premises, with and install, limited maintenance, and removal provided by Cyran Gardens.
Scope and Liability: CBIA is not liable for any damages, injuries, losses, or liabilities related to the Baskets. The Business accepts full responsibility for any associated issues and agrees to indemnify and hold CBIA harmless against any related claims. The Business also releases Cyran Gardens from all liability.
Removal of Baskets: Baskets will be removed by October 1st, 2026, or earlier if in poor condition, without notice. The Business must manage water lines before, during, and after removal without being prompted. CBIA and Cyran Gardens are not liable for any damage during or after removal. The Business may choose to remove the Baskets themselves.
The property owner acknowledges they are responsible for identifying any irrigation systems, wiring, structural concerns, or other hazards that may affect installation.
This Agreement constitutes the entire understanding between CBIA and the Business and supersedes all prior agreements.
